Mort de Rémi Fraisse : la CEDH condamne la France pour violation du droit à la vie

La Cour européenne des Droits de l’Homme estime ce jeudi que « le niveau de protection requis » pour parer aux risques posés par le « recours à une force potentiellement meurtrière » n’a pas été « garanti ».



The European Court of Human Rights (CEDH) has ruled that France violated Rémi Fraisse's right to life by failing to implement necessary measures to prevent the use of lethal force during clashes in 2014 over the Sivens dam. The court highlighted shortcomings in the legal and administrative frameworks and the conduct of the operation. The family and legal team expressed frustration over the delay in acknowledging state responsibility. While the court deemed the investigation thorough, the legal framework at the time precluded criminal charges, resulting in a dismissal. Rémi Fraisse was killed by an explosive grenade thrown by a gendarme during the clashes, which followed orders for a strong presence and led to excessive force, including over 700 grenades.
